Two interesting arbitration proceedings took place in the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry: ADVANTIUM managed to defend the violated rights of a client who leased aviation equipment to a resident of Ukraine, operated it outside Ukraine, but improperly fulfilled its obligations to return the leased property and pay rent and other payments. In turn, the unscrupulous tenant submitted false documents to arbitration, thanks to which he tried to convince the ICAC at the Ukrainian Chamber of Commerce and Industry that the lessor was not the owner of the leased equipment and that any contractual obligations were absent as of the resolution of the controversy. The well-coordinated joint work of ADVANTIUM and the client made it possible to convince the arbitration tribunal of the complete groundlessness of the defendant’s objections and the legitimacy and validity of the claims of the plaintiff – ADVANTIUM’s client. The decision of the ICAC at the Ukrainian Chamber of Commerce and Industry was appealed by the defendant, but his applications were rejected by the court. ADVANTIUM filed applications for the recognition and enforcement of the decisions of the ICAC at the Ukrainian Chamber of Commerce and Industry, which, despite the defendant’s objections, were satisfied by the courts.
